The below information applies to this web shop (C-Pen Shop). If a C-Pen product is purchased via a reseller, reseller’s terms apply.

Who are we? 

Virrata AB and subsidiary C-Pen Trading AB, with Swedish corporate registration No. 556985-2139 and with its principal place of business at Plejelvägen 17, SE-23931 Skanör, Sweden. 

When do these terms apply?

Fully when a C-Pen product is purchased on this website. If a C-Pen product is purchased via one of our reseller, you need to consult reseller’s terms.

VAT

 Unless otherwise specifically stated, prices on this website is inclusive of Swedish VAT.

If you are a private person living within EU (shipping address decides) you always pay Swedish VAT.

If you are an EU based company you can register your VAT # at checkout and pay exclusive of VAT. Without a registered VAT #, VAT will always be charged.

If you are a non-EU private person or company you pay price exclusive of VAT.

General returns

You may return the product (NOTE: this DOES NOT APPLY TO SOFTWARE) within 14 days of receipt of the product for a refund. No questions asked – but the product needs to be returned in original condition including box and accessories. Cost for return freight is on your own expense. Before returning any item you need to contact us at support@cpen.com for a RMA# (return authorization number).

If you purchased your C-Pen product via reseller you need to contact the reseller. We do not refund product not paid for in this webshop.

We reserve ourselves the right to reduce the amount refunded or not to refund anything at all, if the product received by C-Pen is more than reasonably worn or otherwise damaged.

Warranty

We comply with EU consumer rights. Within three (3) years from purchase you may file a notice to us that the product was defective (i.e. was not working or not compliant with specification). This noticed needs to be filed within two months after you notice the defect.

Defects appearing within six (6) months after the purchase is deemed to have existed at delivery. Contact us to claim warranty.

If more than six (6) months have passed when the defect is noticed, it is up to you to prove to us that the defect existed at the time of delivery. 

The warranty does not apply to defects occurring due to normal wear and tear, or if the product has been disassembled and/or altered. Further, as an exception to the general warranty, the battery of the product (if any) is warranted against defects occurring only within the first six (6) months after the product was received.

In case of accepted warranty claim, we will cover the cost for returning the product to us, as well as the cost for sending the replacement/repaired product.

In cases where the defect can not be reproduced we will NOT charge any investigation fee, but we will ask you to cover the shipping cost.

You agree not to

a) Modify, disassemble, reverse engineer or decompile any part of the products unless expressly permitted by applicable law without the possibility of contractual waiver; or
b) Remove any proprietary, copyright, legal or warning texts from the product including its documentation.

You also

acknowledges that we have not designed or intended the products for use in high risk environments requiring fail-safe performance, such as life support systems, chemical plant control systems, air traffic control systems, nuclear facilities, or systems on board airplanes.
